For EB2 I - CY 06, in march it was 10150 and now it is 9900. It has gone down by only 250, in line with ~3000 visas/12 monthly allotment. No spillover or anything for the month of march atleast as per the numbers.

1) I am in USA on H1B.
2) I have accepted an offer to join companyA in January '07. They have filed for the H1B transfer a few days back. And I have resigned from my current employer.
3) Now another companyB has agreed to acquire companyA, and they will close the deal in December '06. CompanyB will be issuing revised offer letters to new hires like myself soon.
So even when my H1B has been filed by CompanyA, it will cease to exist on my joining date (January '07).
My question is how is the H1B handled in such a case ?
Can an amendment be sent to the original application saying its for CompanyB, and not CompanyA. Or does CompanyB have to apply for a fresh H1B ?
General qn : When can I change the employer -- when the H1 papers reach INS or when the lawyers get the receipt notice from INS ?
They are setting up conference calls with the lawyers soon; I was wondering if I could get some inputs from the experts on the forum as well.

Keep new approved H1 and all related documents with you for POE, also EVL.
I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.
I just entered even after new USCIS memo.

You will be able to move to a different employer with better job with better pay. If you are happy with ur current job still it cant proect you if ur current employer gors out of business and fires you.

Hi,
I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.
Will I get visa stamping with
1. Copy of I797A and Employee's related documents ?
2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?
Please guide me Immediately.

I am currently on H1B with a temp status (B1) and in-between jobs. My partner is in the process of becoming a US citizen. He has had his Green Card for years and obtained it through his ex-spouse's job while they were still married. He has been divorced for about a year now and started the citizenship application process a couple of months ago. We are thinking of getting married after he gets his citizenship. My question is: does it matter if we get married before or after he obtains his citizenship? We heard rumors that a previous marriage might be a factor in whether I will be able to obtain a Green Card. Thank you very much in advance for your help!

I sent my I-485 application to USCIS on July 31, 2007. On their website they logged the following message:
"Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Case received and pending.
On September 24, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case....."
Why is the received date Sep 24, 2007 when the application was most likely received on Aug 1, 2007?

It would be very tough to get CP appointment before the end of July. So I am not even thinking of CP. Also CP needs to be approved when your PD is current.

I am a I-485 EB waiter and applied before August 18th. So I have to pay a fee fo 305 dollars. However when I went to check the I-131 instructions for e-filing, i could not find any information if we are eligible to e-file?
has anybody e-filed Advance parole.

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.
I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.
I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.
I would just like to know what are my rights in the above case
